Made in USA Claims on Amazon: Why Listings Get Deactivated

Attorney David Allen Miller scratching his head beside the headline Made in USA? Prove It, Made in USA claims on Amazon guide

Made in USA claims on Amazon must meet the Federal Trade Commission’s standard. The product must be “all or virtually all” made in the United States. If your listing makes that claim and you cannot back it up, Amazon can pull the listing. And the pressure keeps growing, because the FTC has asked Amazon to act against false claims from third party sellers.

Below is what the standard means, why Amazon is cracking down, what triggers a removal, and how to fix or appeal it.

The short version: either prove the claim with records or qualify it. Then make every part of the listing say the same thing.

What Made in USA Claims on Amazon Must Meet

ClaimWhen you can use it
“Made in USA” with no qualifierOnly if all or virtually all of the product is made in the United States
A qualified claim, such as “Made in USA of U.S. and imported parts”When the product does not meet the all or virtually all standard and the qualifier is accurate
An implied claim, through words or imagery that suggest U.S. originThe FTC says its rules cover implied claims too, so the same standard can apply

Why Amazon Is Cracking Down

On July 8, 2025, the FTC sent letters to Amazon and Walmart about third party sellers who appeared to make deceptive “Made in USA” claims. The FTC asked both companies to monitor, identify, and take corrective action against those sellers.

Since then, the scrutiny has kept building. According to one American flag seller, Amazon told flag sellers in January 2026 to verify their claims met FTC requirements by January 22, 2026, or face deactivation. Then, in September 2026, U.S. senators questioned Amazon and Walmart about how their shopping assistants handle origin claims.

What Gets Made in USA Claims on Amazon Pulled

Amazon does not publish its detection methods. Still, the public reporting points to a few common problems.

  • Conflicting origin details. A title says “Made in USA” while the country of origin field or the description says another country.
  • Claims your supplier made for you. A manufacturer’s “USA made” label that you never checked.
  • Patriotic phrasing and imagery. Words or flag graphics that suggest U.S. origin, which can count as an implied claim.
  • No proof on file. A claim you cannot support with records when Amazon asks.

How to Fix or Appeal a Removal

  1. Find every claim. Check the title, bullets, description, A+ content, images, packaging, and the country of origin field.
  2. Check the facts. Trace where each part and step of the product comes from. Then decide whether it meets the all or virtually all standard.
  3. If you can prove it, gather the proof. Collect supplier records, invoices, and production records, and submit what Amazon asks for.
  4. If you cannot prove it, fix the claim. Remove it or qualify it accurately, everywhere it appears.
  5. Make the listing consistent. Also, every field should tell the same origin story.
  6. Keep the file. After that, save your proof in case Amazon or a regulator asks again.

The Risk Goes Beyond Amazon

But a pulled listing is not the only exposure. The Made in USA Labeling Rule, adopted in 2021, gives the FTC civil penalty authority. And legal commentators have reported a rise in class action suits that target Made in USA claims. So fixing your Made in USA claims on Amazon protects more than your sales.

Frequently Asked Questions

What does “all or virtually all” mean?

It means the product should contain no foreign content, or only a negligible amount. If meaningful parts or steps happen abroad, a qualified claim is the safer path.

Can I say “Assembled in USA” instead?

A qualified claim can work when it is accurate. But it still has to be true, so check the facts before you use any origin wording.

My supplier told me the product is made in the USA. Is that enough?

Not on its own, because the claim sits on your listing. So you should hold the records that support it.

Amazon removed my listing over a Made in USA claim. What now?

First, find every place the claim appears. Then either prove it with records or fix it everywhere, and appeal with a clear explanation of what you changed.
